GENERAL TERMS AND CONDITIONS FOR VEHICLE RENTAL:
Between the company AccorAuto and the tenant specified in the contract, the following has been agreed.
ARTICLE 1: OBJECT OF THE CONTRACT
AccorAuto rents the vehicle designated in the contract under the following conditions.
ARTICLE 2: DURATION OF THE CONTRACT
The contract is granted for a fixed period specified in the contract. AccorAuto reserves the right to terminate the contract without justification, compensation, or refund if the tenant fails to comply with any terms of this contract. In the case of early return, the tenant is not entitled to any refund or credit. A day started is fully payable.
ARTICLE 3: EXTENSION
If the tenant wishes to extend the rental, they must request prior approval from AccorAuto at least 48 hours in advance and appear to renew their contract, otherwise they may face legal action from AccorAuto for misappropriation of the vehicle and breach of trust. In case of unauthorized extension, the customer will pay AccorAuto a surcharge of 100% of the rental price for each day of extension. AccorAuto reserves the right to refuse the extension of the contract.
ARTICLE 4: DELIVERY AND RETURN
The vehicle must be returned on business days and during the opening hours of our agencies at the return location specified in the contract.
ARTICLE 5: RENTAL PAYMENT
The rental amount is payable in advance in cash and in Moroccan dirhams. Rental prices are exclusive of taxes. In the case of payment by credit card, the tenant bears an additional 20% VAT and 5.35?nking fees on the total transaction amount.
ARTICLE 6: GENERAL CONDITION OF THE VEHICLE
The tenant acknowledges that they have received the vehicle in good condition. The tenant is fully responsible for all damage caused to the vehicle due to their fault following an accident or due to improper use of the vehicle. The tenant agrees to indemnify AccorAuto without dispute for damages caused to the vehicle according to an estimate provided by the repairer chosen by AccorAuto, as well as for the entire duration of the vehicle's immobilization.
ARTICLE 7: TIRES
The tenant declares having taken the vehicle with five tires in good condition. In case of deterioration of any of them for reasons other than normal wear, the tenant commits to immediately replace the damaged tire with one of the same dimensions and brand.
ARTICLE 8: MECHANICAL CONDITION
Normal wear of the vehicle's mechanical condition is the responsibility of AccorAuto. However, any damage or breakdowns due to wear during the vehicle's use, due to negligence on the part of the client, or accidental causes are the responsibility of the tenant.
ARTICLE 9: ON-BOARD DOCUMENTS
The tenant acknowledges having received all on-board documents for the vehicle and having checked their validity, and commits to keeping them in good condition (registration certificate, insurance, sticker, circulation authorization, technical inspection). In case of loss of these documents, the tenant will pay for the renewal of duplicates and the duration of the vehicle's immobilization.
ARTICLE 10: USE OF THE VEHICLE
The tenant agrees to take care of the vehicle and is prohibited from allowing its use by anyone other than those mentioned in the contract. The vehicle must not be used for the transport of goods except under utility vehicle contracts, for transporting people for payment, for illegal purposes, to participate in rallies, races, contests, or any other competitions, to travel off paved roads except for 4x4 vehicles, to abandon the vehicle for any reason, to tow or push any vehicle or trailer, or to make repairs on the vehicle without the company's consent. AccorAuto disclaims any responsibility for illegal use of the vehicle by the tenant.
ARTICLE 11: REPAIR OF THE VEHICLE
The tenant is prohibited from making any repairs on the vehicle in the event of a breakdown or accident without the company’s consent. If repairs are made without AccorAuto's consent, the tenant cannot claim any reimbursement and agrees to pay AccorAuto the amount of repairs necessary to restore the vehicle to its original condition based on an estimate provided by the company or one of its dealers.
ARTICLE 12: INFRACTIONS AND FINES
The tenant is solely responsible for any infraction committed by themselves or by the driver of the vehicle and will bear the costs and penalties (fines, citations, etc.).
ARTICLE 13: ACCIDENTS
In the event of an accident, the tenant agrees to immediately notify AccorAuto. The tenant also agrees to present AccorAuto with a duly filled and signed amicable report or a police or gendarmerie report.
ARTICLE 14: RECOVERY OF THE VEHICLE
The tenant is strictly prohibited from abandoning the immobilized vehicle. The recovery of the vehicle remains the tenant's responsibility, and rental payments remain due until the vehicle and its documents are returned.
ARTICLE 15: INSURANCE
The insurance contract taken out by AccorAuto is strictly personal. The tenant cannot benefit automatically from the rental contract with AccorAuto unless expressly stipulated in the contract. Apart from the general and specific conditions of the insurance contract taken out by AccorAuto for its vehicles, the tenant is insured only for civil liability towards third parties unless stated otherwise. Under the specific conditions of this contract, the tenant remains responsible for all damages caused to the vehicle due to improper use or as a result of an accident, regardless of the circumstances, and agrees to pay AccorAuto the amount of damages determined by a repairer chosen by AccorAuto, as well as the rental of the vehicle during the immobilization period necessary for the repair of the vehicle based on the estimate. Only the estimated damage and immobilization duration is sufficient for AccorAuto to claim payment from the tenant.
ARTICLE 16: VEHICLE IMMOBILIZATION
The tenant agrees to pay AccorAuto the rental amount for the vehicle during the immobilization period for repairs due to damage caused to the vehicle from an accident, regardless of who is at fault, for repairs due to improper use, and for reproducing duplicate on-board documents that are lost or not returned by the tenant.
ARTICLE 17: ILLEGAL USE OF THE VEHICLE
In case of confiscation of the vehicle by the authorities due to its illegal use, such as the transport of drugs or contraband, the tenant agrees to pay AccorAuto the replacement value of the vehicle as compensation.
ARTICLE 18: TENANT DEFAULT
The tenant loses all rights conferred by this contract in the event of non-compliance with any clause of the contract.
ARTICLE 19: JURISDICTION
In case of dispute or contestation, only the courts of Casablanca have jurisdiction.
